General Terms and Conditions of Online Sales
These terms and conditions of sale are agreed upon between, on the one hand, Idylle, a company with a capital of 249,700.00 euros, whose registered office is located in Chauvigny, registered with the Poitiers Trade and Companies Register under number 523 091 965, hereinafter referred to as “Idylle,” and, on the other hand, any natural or legal person wishing to make a purchase via Idylle’s website, hereinafter referred to as the “Buyer.”
Article 1. Purpose
These Terms and Conditions of Sale are intended to define the contractual relationship between Idylle and the Buyer, as well as the conditions applicable to any purchase made through Idylle’s e-commerce site, whether the Buyer is a business or a consumer.
The purchase of a good or service through this website implies the Buyer’s unconditional acceptance of these Terms and Conditions of Sale.
These Terms and Conditions of Sale shall prevail over any other general or specific terms and conditions not expressly approved by Idylle.
Idylle reserves the right to update these Terms and Conditions of Sale at any time. In such cases, the applicable terms and conditions will be those in effect on the date the buyer places the order.
Article 2. Characteristics of the Goods and Services Offered
The products and services offered are those listed in the catalog published on the Idylle website.
These products and services are offered while supplies last.
Each product is accompanied by a description provided by the supplier; for some products, the buyer may have access to the supplier’s documentation.
The photographs in the catalog are as accurate as possible but cannot guarantee a perfect likeness to the product offered, particularly with regard to colors and appearance.
Article 3. Prices
The prices listed in the catalog are in euros, inclusive of tax, reflecting the VAT rate applicable on the date of the order; any change in the tax rate may be reflected in the price of the products or services.
Idylle reserves the right to update its prices at any time; however, the price listed in the catalog on the date of the order shall be the only price applicable to the buyer.
The prices listed include order processing fees but do not include shipping and delivery charges.
Article 4. Geographic Area
Online sales of the products and services presented on the website are limited to buyers residing in France, the French overseas departments and territories, or Monaco, and are for deliveries to these geographic areas.
Article 5. Orders
A buyer wishing to purchase a product or service must:
– complete the registration form, providing all requested contact information;
– confirm the order after reviewing it;
– make payment in accordance with the specified terms;
– confirm the order and payment.
Confirmation of the order constitutes acceptance of these terms and conditions of sale, acknowledgment of full knowledge of them, and a waiver of the right to invoke the buyer’s own terms and conditions of purchase or any other terms and conditions.
All data provided and the recorded confirmation shall serve as proof of the transaction. The confirmation shall constitute a signature and acceptance of the transactions carried out.
The seller will send confirmation of the registered order via email.
Article 6. Right of Withdrawal
Buyers who are non-professional individuals have a 14-day withdrawal period beginning on the date of delivery of their order to return the product to the seller for an exchange or refund without penalty, except for return shipping costs.
Article 7. Payment Terms
Payment is due at the time of order.Payments will be made by credit card through the secure system provided by HIPAY, which uses the SSL (Secure Socket Layer) protocol to ensure that transmitted information is encrypted by software and cannot be accessed by any third party during transmission over the network.
The buyer’s account will be charged after the order is confirmed.
An invoice showing the VAT is available at any time in the buyer’s account or upon request.
Article 8. Deliveries
Deliveries are made to the address specified in the order, which must be within the agreed-upon geographic area.
The buyer assumes all risks once the products have left Idylle’s premises. In the event of damage during transit, a written complaint must be filed with the carrier within three days of delivery.
Delivery times are provided for informational purposes only; if they exceed thirty days from the date of the order, the sales contract may be terminated and the buyer refunded.
Article 9. Warranty
All products supplied by the seller are covered by the statutory warranty provided for in Articles 1641 et seq. of the Civil Code.
In the event of non-conformity of a product sold, it may be returned to the seller, who will accept the return, exchange the product, or issue a refund.
All complaints, requests for exchanges, or refunds must be submitted by mail to the following address: Idylle, 20 rue des entrepreneurs, ZI du Peuron, 86300 Chauvigny, or by email to lingerie-bain@idylle.fr, within thirty days of delivery.
Article 10. Liability
In the online sales process, the seller is bound only by an obligation of means; the seller shall not be held liable for any damage resulting from the use of the Internet, such as data loss, unauthorized access, viruses, service interruptions, or other unforeseen issues.
Article 11. Intellectual Property
All elements of the Idylle website are and remain the exclusive intellectual property of Idylle.
No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever—even partially—any elements of the website, whether software, visual, or audio.
Article 12. Personal Data
In accordance with the French Data Protection Act of January 6, 1978, personally identifiable information relating to purchasers may be subject to automated processing.
Idylle reserves the right to collect information about buyers, including through the use of cookies, and, if it so chooses, to share the collected information with business partners.
Buyers may object to the disclosure of their contact information by notifying Idylle. Similarly, users have the right to access and correct data concerning them, in accordance with the law of January 6, 1978.
The automated processing of information, including the management of website users’ e-mail addresses, was declared to the CNIL on ………… and registered under number …………
Article 13. Archiving - Evidence
Idylle will archive invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1348 of the Civil Code.
Idylle’s computerized records shall be considered by the parties as proof of communications, orders, payments, and transactions between the parties.
Article 14. Dispute Resolution
These online terms and conditions of sale are governed by French law.
In the event of a dispute, jurisdiction is assigned to the competent courts of Poitiers, notwithstanding multiple defendants or the joinder of third parties.
